Auction Loction: Moose Lodge, 2510 Main St, Lexington, MO 64067

Method of Auction:The farms sells by the acre with 102.57 taxable acres as the multiplier to establish the final selling price.  Property sells with the confirmation of the bid price by the seller.  This will be a live onsite auction with internet bidding available through WheelerLive.  Internet bidders must be preapproved 24 hours prior to the sale.

Tenant/Possession:  Immediate possession of the farm will be granted upon signing the land sale contract and receiving the escrow down payment. There is no tenant agreement in place for the 2024 crop, however, the current tenant, Matt Bertz, would like to submit a proposal to continue farming the land in the event that a non-farmer or investor is the buyer.  Other farmers in the area are interested in farming this ground as well.

The horse tenant, Marvin Harrison, would like to continue the rental agreement for his horses.  However, the horses and electric fence lots will be removed from the property on or before 3-15-2024 if the buyer does not wish to extend the agreement. 

Contract:  Immediately following the conclusion of the land sale, we will write the sale contracts and receive the escrow/earnest money of 10% down payment.  Payment check is non-refundable and payable to Truman Title Co, LLC

Closing:  Closing on or before Wednesday, March 20, 2024 at the office of Truman Title Company LLC,

Taxes:  The 2023 taxes on this property will be paid by the seller and are in the amount of $514.95.  The Tabo Watershed Tax is included in this total.  The Buyer will be responsible for all 2024 taxes.  

Utilities:  West Central Electric along Cole Lane and Route E.  There is a meter on the property at the old farmstead. 

Water:  The property has Rural Water, District #2 of Lafayette Co along Cole Lane and Route E with a water meter at the brick house.  

Schools:  The property is in the Lexington R5 School District

Down Payment: Ten percent (10%) nonrefundable down payment the day of auction, upon signing a purchase agreement immediately following the close of bidding. The down payment may be paid in the form of personal check, business check, or cashiers check. The remainder of the purchase price is payable at closing.  YOUR BIDDING IS NOT CONDITIONAL UPON FINANCING. Be sure you have arranged financing, if needed, and are capable of paying the balance at closing.

Title:  Sellers shall provide and execute a proper deed conveying the real estate to the buyer(s). Seller to pay for title insurance premium including title search and examination fees.  Buyer to pay any lender fees, search premiums, or appraisals necessary to secure buyers funds for closing.  Buyer and seller will split the closing costs.

Mineral RightsThe sale shall include 100% of the mineral rights owned by the sellers.

Easements:  Utility and water easements are in place on the farm.  

Acreage/Survey:  All acreages are approximate and accurate to the best of our ability using assessors maps, measurements, and legal descriptions. The selling price based on the acreage multipliers is final and no future adjustments in sale price will be granted to either the buyer or seller of said acreage or Tracts.  Any need for a survey to close this agreement is at the sole discretion of the Seller.  Any need for a survey by the Purchaser, to acquire funding or close this agreement will be paid for by the Purchaser.  However, in the event a suvery is required to close the transaction, the final selling price will be adjusted to the surveyed acres within each Tract(s).

The Estabrook farm is in a great location being just South and East of Lexington.  It has nearly ½ mile of HWY E frontage.  The old Brick home is burned out but its location offers a great home sight if you wish to build.   The timber draw and Garrison Creek offer an abundance of Turkey or Deer whether you wish to be a hunter or want to just enjoy the view of wildlife.

This ground is fertile with 65 row crop acres.  The west side of the farm is accessed from Cole Lane and contains 16 acres of the crop ground. We hope you will plan to be with us on February 9th, visit with Bob, and exercise your option as a bidder and a buyer on this 102.57 acres of Lafayette County soil.
